Miscellaneous Professional Insurance Claim Examples

Here are some claim examples that illustrate what Miscellaneous Professional Insurance covers.

A property manager rented a condominium unit to a new tenant in a largely residential neighborhood. Prior to entering the lease, the property manager contacted the tenant’s references, all of which checked out. However, not long after moving in, the tenant began throwing loud late-night parties, leading to multiple complaints from neighbors. After several written warnings from the property manager that failed to correct the problem, the property owner evicted the tenant and removed their property from the unit. The tenant sued both the property manager and the property owner for breach of the lease agreement, wrongful eviction, and violation of local landlord-tenant laws.

The plaintiff entered into a contract to open a franchise of a home healthcare company in the Midwest. As part of the agreement, the plaintiff was required to use a subsidiary of the franchisor to manage its medical billing and coding, revenue cycle management, and credentialing, in exchange for a separate royalty payment. The plaintiff claimed that the subsidiary mistakenly failed to submit timely and complete billing for various services, causing the plaintiff to miss out on hundreds of thousands of dollars in revenue. The resulting financial strain allegedly forced the plaintiff to sell its franchise at a below-market price. The plaintiff sued the healthcare company and the medical billing subsidiary for a host of claims including negligence and declaratory relief.

A business hired a public relations and marketing firm to help promote the opening of their new store specializing in sustainably-produced artisan goods. The PR firm created an advertising campaign for the client that included the social media distribution of a coupon good for a discount on purchases made at the store’s grand opening. Unfortunately, the barcode on the final version of the coupon inadvertently granted a bigger discount than what had been agreed to and also failed to include an expiration date. Although the error was eventually fixed, the “extended sale” resulted in smaller profit margins for a longer period of time than the client expected or desired. The client filed suit against the PR firm for breach of contract and negligence.
