Counterpart offers advisor services in addition to standard technical and product support, which includes help with HR related questions requiring advice, guidance, best practices, compliance, and more. Employment Practices (EPLI) policyholders who enroll in these services are provided a HR Resource Center with useful HR templates and access to HR employment experts that can provide tailored advice.
HR Counterpart is only available to policyholders that purchase employment practices (EPLI) insurance. You are automatically enrolled into HR Counterpart when you purchase EPLI coverage through Counterpart.
Counterpart has partnered with certified HR employment experts to help you with your toughest HR questions. Whether you need help dealing with complex employee circumstances or navigating state compliance, our HR experts have over 10 years of experience getting business leaders to the right answer.
The HR Resource Center and HR Employment Experts can help with a wide variety of HR topics: harassment training, termination guidelines and documentation, wage & hour compliance, job descriptions, hiring best practices, employee handbooks, COVID guidelines, and state compliance. Our HR Experts are here to provide helpful advice to your HR questions, but are not a replacement for dedicated HR personnel or legal counsel.
Policyholders are not penalized upon renewal for utilizing Counterpart’s advisor services. We encourage you to use HR Counterpart to reduce your risk of claims and workplace disputes. You can even earn a Retention Benefit up to $5,000 by leveraging HR Counterpart.
Counterpart offers policyholders a 10% EPLI Retention Benefit (up to $5,000) for consulting with an HR Employment Expert on a qualifying incident or event that later leads to a claim of harassment, discrimination, or retaliation (as defined by the EEOC). Qualifying topics include:
- Advice prior to layoffs or furloughs
- Advice prior to employee termination or discipline
- Advice on handling harassment or discrimination incidents
- Advice on requests for reasonable accommodation or a leave of absence
Counterpart also offers policyholders a 5% EPLI Retention Benefit (up to $5,000) for reporting a claim within 48 hours of receiving notice.
To become eligible for the Risk Mitigation Retention Benefit one of the following scenarios must occur:
Scenario 1. Report of Harassment, Discrimination, or Retaliation
1. Policyholder schedules a meeting through the Attorney on Call service regarding a report of harassment, discrimination, or retaliation through our website within two (2) business days of its occurrence.
2. Policyholder has a discussion with an HR Employment Expert about the incident.
Scenario 2. Impending Termination or Discipline
1. Policyholder schedules a meeting through the Attorney on Call service regarding an anticipated termination or disciplinary action through our website twenty-four (24) hours prior to conducting any termination or disciplinary action.
2. Policyholder has a discussion with an HR Employment Expert about the anticipated event.
Scenario 3. Impending Layoffs or Furloughs
1. Policyholder schedules a meeting through the Attorney on Call service regarding anticipated layoffs or furloughs through our website five (5) business days prior to conducting any layoff or furlough.
2. Policyholder has a discussion with an HR Employment Expert about the anticipated event.
Scenario 4. Request for Reasonable Accommodation or Leave of Absence
1. Policyholder schedules a meeting through the Attorney on Call service regarding a Request for Reasonable Accommodation, Family Leave, Medical Leave, or Military Leave through our website twenty-four (24) hours prior to responding to the request for reasonable accommodation, family leave, medical leave, or military leave.
2. Policyholder has a discussion with an HR Employment Expert about the request.
In the event that the incident, anticipated event, or request for which the Policyholder sought advice through the Attorney On Call service turns into an accepted claim, Counterpart will reduce the retention as listed on the declarations page of the employment practices (EPLI) policy by the lesser of 10% of the total retention benefit or $5,000.
Conditions:
1. The incident, anticipated event, or request discussed with an HR Employment Expert must not qualify for a claim.
2. The ensuring claim arising out of the incident, anticipated event, or request must be approved under the coverage of the employment practices (EPLI) policy.
3. Prior to applying the retention benefit, Counterpart will confirm with the HR Employment Expert that the Policyholder consulted with an HR Employment Expert as described in the call transcript.
4. Policyholders can only receive one retention benefit per claim and can only receive a max retention benefit of $5,000 across all claims in a single policy period.
